Definitions
Client: any professional or legally capable natural person within the meaning of articles 1123 et seq. of the French Civil Code, or legal entity, who visits the site covered by these general terms and conditions.
Services and offerings: optimcar.fr provides clients with content, i.e. all the elements making up the information present on the site, in particular texts, images and videos.
Client information: hereinafter referred to as “Information”, these correspond to all the personal data that may be held by optimcar.fr for the management of your account, customer relationship management and for analysis and statistical purposes.
User: internet user connecting to and using the aforementioned site.
Personal information: “information that allows, in any form whatsoever, directly or indirectly, the identification of the natural persons to whom it applies” (article 4 of French law no. 78-17 of 6 January 1978).
The terms “personal data”, “data subject”, “processor” and “sensitive data” have the meaning defined by the General Data Protection Regulation (GDPR no. 2016-679).
1. Presentation of the website
Pursuant to article 6 of French law no. 2004-575 of 21 June 2004 on confidence in the digital economy, users of the optimcar.fr website are informed of the identity of the various parties involved in its creation and maintenance.
2. General terms of use of the site and the services offered
The site is an intellectual work protected by the provisions of the French Intellectual Property Code and applicable international regulations. The client may in no way reuse, transfer or exploit for their own account all or part of the elements or works of the site.
Use of the optimcar.fr site implies full and unreserved acceptance of the general terms of use described below. These terms may be modified or supplemented at any time; users are therefore invited to consult them regularly.
This site is normally accessible at all times. However, an interruption for technical maintenance reasons may be decided by optimcar.fr, which will endeavor to inform users in advance of the dates and times of the intervention.
3. Description of the services provided
The purpose of the optimcar.fr site is to provide information about all the company's activities. optimcar.fr strives to provide information that is as accurate as possible, but cannot be held responsible for omissions, inaccuracies and shortcomings in updates, whether caused by itself or by third-party partners. All information is provided for guidance only and is subject to change.
4. Contractual limitations on technical data
The site uses JavaScript technology and cannot be held responsible for material damage related to its use. The user agrees to access the site with up-to-date, virus-free equipment and an up-to-date browser.
The site is hosted by a provider located within the territory of the European Union, in accordance with the GDPR. The host ensures the continuity of its service 24/7, every day of the year, subject to occasional interruptions for maintenance or improvement of its infrastructure. optimcar.fr and its host cannot be held responsible in the event of malfunction of the internet network, telephone lines or computer equipment.
5. Intellectual property and infringement
optimcar.fr owns the intellectual property rights and holds the usage rights to all the elements accessible on the site: texts, images, graphics, logos, videos, icons and sounds. Any reproduction, representation, modification, publication or adaptation of all or part of these elements, by whatever means used, is prohibited without the prior written authorization of optimcar.fr.
Any unauthorized use of the site or any of its elements will be considered as constituting infringement and prosecuted in accordance with articles L.335-2 et seq. of the French Intellectual Property Code.
6. Limitations of liability
optimcar.fr acts as the publisher of the site and is responsible for the quality and accuracy of the content it publishes. optimcar.fr cannot be held responsible for direct and indirect damage caused to the user's equipment when accessing the site, resulting from equipment that does not comply with the specifications of article 4, or from the appearance of a bug or incompatibility, nor for indirect damage resulting from the use of the site.
Interactive spaces (contact form) are available to users. optimcar.fr reserves the right to delete, without prior notice, any content posted that would contravene applicable French legislation, in particular regarding data protection, and to hold the user civilly and/or criminally liable in the event of a racist, insulting, defamatory or pornographic message.
7. Management of personal data
The client is informed of the applicable regulations regarding marketing communications: the law of 21 June 2004 on confidence in the digital economy, the French Data Protection Act of 6 August 2004, as well as the GDPR (no. 2016-679).
7.1 Party responsible for collecting personal data
For the personal data collected as part of account creation and browsing on the site, the data controller is VROOMIZ, represented by its legal representative. optimcar.fr undertakes to comply with the framework of the legal provisions in force, to establish the purposes of its processing and to maintain a processing register consistent with reality.
7.2 Purpose of the data collected
- Enable browsing on the site and management of the services ordered (connection data, billing, order history)
- Prevent and combat computer fraud (equipment used, IP address, hashed password)
- Improve browsing on the site (connection and usage data)
- Conduct optional satisfaction surveys (email address)
- Run communication campaigns by SMS or email (phone number, email address)
optimcar.fr does not sell your personal data: it is used only out of necessity or for statistical and analytical purposes.
7.3 Right of access, rectification and objection
In accordance with the European regulations in force, you have the following rights:

7.4 Non-disclosure of personal data
optimcar.fr refrains from processing, hosting or transferring the collected information to a country located outside the European Union, or recognized as “inadequate” by the European Commission, without first informing the client. optimcar.fr remains free to choose its technical and commercial subcontractors, provided that they offer sufficient guarantees with regard to the GDPR.
In the event of an incident affecting the integrity or confidentiality of the data, optimcar.fr will inform the client as soon as possible and communicate the corrective measures taken. optimcar.fr does not collect any sensitive data. The data may be processed by subsidiaries and subcontractors of optimcar.fr, exclusively for the purposes described above.
8. Incident notification
No method of transmission over the internet or electronic storage is completely secure: we therefore cannot guarantee absolute security. In the event of a security breach, we will notify the affected users so that they can take appropriate measures.
No personal information is published without the user's knowledge, exchanged, transferred, assigned or sold to third parties. Only the hypothesis of the acquisition of optimcar.fr and its rights would allow the transmission of this information to the possible acquirer, who would be bound by the same obligations. To ensure the security and confidentiality of the data, optimcar.fr uses networks protected by standard measures: firewall, pseudonymization, encryption and passwords.
9. Hyperlinks, cookies and internet tags

9.2 Internet tags (“tags”)
optimcar.fr may occasionally use internet tags (“tags”, transparent or invisible GIFs), deployed via a web analytics specialist partner, which may store the corresponding information, including the user's IP address, in a foreign country. These tags make it possible to evaluate visitors' responses and the effectiveness of the actions carried out on the site.
10. Applicable law and jurisdiction
Any dispute relating to the use of the optimcar.fr site is subject to French law. Except in cases where the law does not permit it, exclusive jurisdiction is granted to the competent courts of Orléans.
11. Use of data within Google My Business
We collect and process the following data when you use our service to manage your Google My Business listing:
- Identifier of your Google My Business listing: required to allow you to interact with your specific listing
- Identifier of your Google account: allows you to be authenticated and authorized to access your listing
This data is used exclusively to connect you to your Google My Business account and manage your listing (publishing, editing, deleting content). We do not share your data with third parties, with the exception of Google, which uses it in accordance with its own privacy policy, available at policies.google.com/privacy.
We have implemented appropriate technical and organizational security measures to protect your personal data against any unauthorized access, loss, misuse, disclosure, alteration or destruction.
